Spanish law envisages two phases: One out of court and subsequently, if that fails, one in court.
Should an amicable settlement not be reached, the debtor is issued a formal notice to comply by registered letter which envisages payment within 10 days after which it is possible to take legal action.
The Spanish procedure allows legal action to be taken also without defense counsel for amounts up to 30,000 euros.
The creditor can request an order for payment (Peticion) by formulating an appropriate application and attaching the supporting documents. If the court considers the claim founded, it orders the debtor to pay or to object within 20 days. The debtor can pay or raise an objection.
In the case of an objection, the monitory proceedings become legal proceedings.
