Also in Romania it is always preferable to attempt out of court collection, so-called amicable credit collection, which, frequently, achieves reasonable success in a short space of time.
If this does not produce the desired results, Romanian legislation allows us to carry out a second step. In February 2013 in fact, the new Civil Procedure Code came into force: Law No. 134 of 2010 with the objective of attempting mediation before the monitory procedure.
In the event of unsuccessful mediation and if the receivable has not exceeded the limitation period (3 years) the creditor may initiate legal proceedings.
Jurisdiction to decide disputes with value of less than 500,000 Ron lies with the local courts (Judecatoria), otherwise the case is referred to the normal courts.
Government Ordinance No. 5 of 2001 also established a special order for payment procedure via which it is possible to take action to collect a receivable in the presence of documentary evidence and acknowledgement of the debt.
