Once out-of-court credit collection has been attempted without success, legal action will be taken.
In Portugal there is the “injunção” procedure which is very similar to an Order for Payment.
It is a quick and economical way of obtaining legal certification of the receivable and consists of legally serving notice on the debtor to pay the overdue debt (plus interest and certain expenses) especially when there is no dispute.
The Order for Payment, once notified to the counterparty, envisages a deadline of 15 days for objection, after which it is declared enforceable. Enforceability is declared within 50 days of filing. If, on the other hand, there is an objection, legal proceedings ensue which can take on two forms:
For receivables of less than €30,000: The special process applies – a very fast and streamlined procedure
For receivables exceeding €30,000: Normal legal proceedings apply which envisage the exchange of briefs and normal evidence via witnesses, carried out via international letters rogatory for foreign witnesses.
