In Algeria, our credit collection activities consist of three distinct phases:

  • Pre-litigation: while being managed by our local lawyer, roughly corresponds to out-of-court activity and is the phase in which are verbal or written reminders are sent. It is a rapid and fairly effective phase to try to avoid further costs. The fact that the stimulus comes from our law firm usually leads recalcitrant customers to comply in order to avoid the litigation phase. During this phase, normally information is gathered concerning the debtor to verify its solvency or take measures to preserve the rights of our Clients.
  • The second phase is automatically initiated in the absence of an adequate response within 15 days. This phase consists of sending a letter of formal notice to pay, which will be notified to the debtor by a bailiff, also in order to charge statutory arrears interest, but also to give a deadline, typically eight days. The bailiffs are in direct contact with the debtor on our behalf. During this phase, our lawyers generally increase the pressure on the debtor by telephone calls in order to illustrate the advantages of amicable collection and the risks of legal proceedings.
  • The third phase involves legal proceedings. This is normally initiated in parallel with other precautionary measures, such as the seizure of bank accounts and repossession of the debtor’s assets. Note that any decision taken by a judge must be notified to the debtor by a bailiff. The legal phase ends either with the payment of the receivable or may continue in order to obtain enforcement on the debtor’s property. The only caveat is that all documents in a language other than Arabic must be translated into such language to be used in court.
